Rental Property Inspection Process

Understand code inspections, violations, repair timelines, and tenant rights during inspections in Cuyahoga and Lorain counties.

Who Conducts Inspections?

Rental property inspections in Ohio are typically conducted by:

  • City/County Health Department — General code violations
  • Building Department/Code Enforcement — Structural and safety issues
  • Fire Department — Fire safety, smoke detectors, exits
  • HUD Inspectors — For Section 8 units (Housing Quality Standards inspections)
  • Tenant-initiated — When a tenant requests an inspection for habitability issues

Common Code Violations

  • Lack of heat or hot water
  • Broken windows or doors
  • Pest infestation (rodents, insects)
  • Mold or moisture damage
  • Unsafe electrical systems
  • Plumbing issues (no working toilet, sink, or water)
  • Missing smoke/carbon monoxide detectors
  • Structural damage or unsafe conditions
  • Lead paint hazards (pre-1978 homes)
  • Improper egress (emergency exits)

Inspection Notice Requirements

In Ohio, you must provide notice before inspection in most cases:

  • Regular (non-emergency) inspections: 24-hour notice required
  • Emergency inspections: No notice needed (e.g., gas leak, fire hazard, no heat in winter)
  • Tenant-requested: Usually 24-48 hours' notice from the inspector

Notice should specify:

  • Date and time of inspection
  • Reason for inspection
  • Inspector's name and agency
  • Tenant's right to be present

What to Expect During an Inspection

Inspectors will examine:

  • Kitchen appliances and plumbing
  • Bathroom fixtures and ventilation
  • HVAC/heating systems
  • Electrical outlets and wiring
  • Structural integrity (walls, ceiling, floor)
  • Fire safety equipment
  • Pest presence or damage
  • Overall cleanliness (in some cases)
Note: Inspectors are usually not concerned with normal wear and tear or tenant-caused clutter. Focus is on safety and habitability.

Violation Classification & Timelines

Critical/Emergency Violations

Examples: No heat, no water, gas leak, active mold, structural danger
Timeline for repair: 24-72 hours (depending on severity)

Major Violations

Examples: Broken windows, missing door, electrical hazard
Timeline for repair: 7-14 days

Minor Violations

Examples: Missing outlet cover, paint chipping
Timeline for repair: 30 days

Repair Obligations & Deadlines

Once violations are cited, you must:

  • Make repairs within the specified timeline
  • Document repairs with photos or receipts
  • Schedule a re-inspection to verify compliance
  • Pay re-inspection fees if applicable
Important: Failing to repair violations can result in fines, liens on your property, or tenant rent withholding. Prioritize compliance.

Tenant Rights During Inspections

  • Right to 24-hour notice (in non-emergencies)
  • Right to be present during inspection
  • Right to request re-inspection if repairs aren't made
  • Right to receive a copy of violations cited
  • Right to withhold rent or request repairs if habitability is affected

HUD Housing Quality Standards (HQS) for Section 8

If you have a Section 8 unit, HUD requires annual inspections. Common issues that fail HQS:

  • Any code violations (same as above)
  • Cleanliness issues (moderate to heavy clutter)
  • Appliances not functioning
  • Safety hazards

If your unit fails HQS inspection, the PHA will suspend subsidy payments until repairs are made and re-inspection passes.
